Draft bill 691 aims to establish a presumption of legitimate self-defence or of legality for law enforcement officials when they use their firearms in the line of duty.

In other words, the proposition would mean that officers who killed someone in a shooting incident would be presumed to have acted within the limits of the law, unless there was proof to the contrary.

The text says the presumption of self-defence “may be rebutted if the judicial investigation demonstrates that the use of weapons was manifestly disproportionate or contrary to the principle of absolute necessity established by law”.

Deputies in the National Assembly approved the bill in July. A vote on the proposed legislation will now take place in the Senate, the upper house of the French parliament.

Proposition de loi visant Ă  reconnaĂźtre une prĂ©somption de lĂ©gitime dĂ©fense pour les forces de l'ordre, dans l'exercice de leurs fonctions, n° 691, dĂ©posĂ©e le mardi 3 dĂ©cembre 2024.

Article unique

AprĂšs l’article 122‑6 du code pĂ©nal, il est insĂ©rĂ© un article 122‑6‑1 ainsi rĂ©digĂ© :

« Art. 122‑6‑1. – Est prĂ©sumĂ© avoir agi en Ă©tat de lĂ©gitime dĂ©fense, l’agent de la police nationale ou municipale ainsi que le militaire de la gendarmerie nationale, qui a fait usage de son arme dans les conditions prĂ©vues par les articles L. 435‑1 et L. 511‑5‑1 du code de la sĂ©curitĂ© intĂ©rieure.

« La prĂ©somption de lĂ©gitime dĂ©fense prĂ©vue au premier alinĂ©a peut ĂȘtre renversĂ©e si l’enquĂȘte judiciaire dĂ©montre une utilisation des armes manifestement disproportionnĂ©e ou contraire au principe de nĂ©cessitĂ© absolue Ă©tabli par la loi. »
